Everton to Appeal £40m Burnley Compensation Ruling

Everton have confirmed they will challenge a decision ordering the club to pay compensation to Burnley over alleged financial rule breaches.

Everton FC has announced plans to appeal a ruling by the Premier League Independent Disciplinary Commission that requires the club to compensate Burnley for the impact of breaching financial regulations in 2022. Reports in British media suggest the Merseyside club could be liable for nearly £40 million in damages.

The dispute centres on Everton’s breach of the Premier League Profit and Sustainability Rules (PSR) and whether it contributed to Burnley’s relegation during the 2021–22 season. Everton strongly rejected the panel’s conclusion, arguing that the findings are incorrect and already addressed through earlier sporting sanctions.

“The Club does not recognise the findings of the panel in determining Burnley’s relegation from the Premier League in May 2022 was caused by a sporting advantage gained by Everton due to a breach of Profit & Sustainability Rules, for which a substantive sporting sanction has already been received,” the club said.

Everton described the ruling as flawed and warned it could have wider consequences for English football governance. The club argued that the decision creates an “unworkable precedent” by suggesting a team can be found in breach of financial rules at any point in a season and later held responsible for relegation outcomes.

The Everton financial rules appeal also challenges the interpretation of evidence used by the commission. The club said it believes the panel misrepresented key arguments presented by its legal team and expressed confidence that a future appeal would succeed.

Everton were initially handed a 10-point deduction in November 2023 for breaching financial regulations. That penalty was later reduced to six points following an appeal and applied to the 2023–24 Premier League season.

The Everton financial rules appeal dispute with Burnley focuses on whether that deduction, if applied earlier, could have altered the relegation outcome. Everton finished 16th in the 2021–22 season with 39 points, narrowly ahead of Leeds United on 38 points, while Burnley were relegated in 18th place with 35 points.
